The then 20-year-old from Zurich hit Anita B’s Ford B on a rented BMW M5 at Dietikon in October 2019. She and her four-year-old daughter were seriously injured. On Wednesday, the 22-year-old had to answer before the Dietikon District Court.
In the evening, the court pronounced the sentence: the man was unconditionally sentenced to 46 months in prison for, among others, multiple serious injuries and multiple failures of emergency care. In addition, the accused will be expelled from the country for seven years. He must also pay the victim’s family a total of approximately 150,000 francs.
The judge justified the verdict with credible testimony. This would confirm that the accused accelerated and decelerated many times. “They wanted to test the car.” He had an accident while doing this. “Today we know that the victims survived. But it could have turned out otherwise. ” The judge found that the 22-year-old did not take care of his mother and daughter. The accused did not make the correct emergency call. “They had time to say on the phone that two people had been injured.” However, he did not.
The perpetrator lit a cigarette after the accident
According to the indictment, the accused had set up a sports driving program in the car and turned off stability control. It is rumored that he later lost control of the vehicle. He is also accused of not caring for the victims. As reported by “Blick”, the accused denied it in court. He talked to the mother and measured his daughter’s pulse. Then, shocked, he went to his car and lit a cigarette. He doesn’t know anymore.
In the case of the accident, the accused told the court that he sped up onto Bernerstrasse, after which there was an accident. “I slipped. There was nothing I could do.” As the 22-year-old admits, he changed the car’s setup. However, the reason for this remains open. During the trial, the 22-year-old apologized to the injured family: “I would like to reverse the trip. It’s just impossible. Sorry.”
“He has trouble concentrating. She also has headaches a lot. “
As reported by “Blick,” the mother said in court that her daughter was still suffering from the consequences of the accident: “She has difficulty concentrating. She also has headaches a lot. ” In school, the first grade needs a little more time. “Writing numbers or letters is still difficult.” Neither the accused nor his lawyer ever contacted her after the accident or asked how she was feeling.
According to the indictment, the mother suffered a craniocerebral trauma, nerve damage in her right arm and various fractures in the accident. Her daughter was diagnosed with multiple trauma: broken bones in the head, fractures of the second cervical vertebrae, ribs, thoracic vertebrae and sternum, as well as torn ligaments, hematoma on the meninges, ruptured liver and lung contusion. The child still suffers from bilateral paralysis of the eye muscles, has problems with visual-spatial perception and language functions.
“Characterless and inhuman”
The prosecution ordered the 22-year-old to be imprisoned for four years and deported for seven years. The suspect accepted the accident. “He changed settings and as a result he lost control. Two-tonne BMW versus Ford Focus – it was like David versus Goliath. ” The prosecutor justifies referral to the country, inter alia, bypassing emergency care: “It’s characterless and inhuman. He did not hold the child’s hand or persuade him.
In turn, the defendant’s lawyer asked for a 20-month imprisonment for negligence and serious bodily harm. Reference to a country should be avoided. Your customer skidded at 74 instead of 60 km / h, which is not overspeed. He explains the accident as overconfidence and neglect. The victim’s family lawyer demanded compensation of almost 150,000 francs. Since the accident, his clients’ lives have changed drastically. “It’s just lucky they’re still alive.”
